RELEASE OF LIABILITY AND INDEMNITY AGREEMENT

By using our services, you (“the Client”) agree to the following legally binding terms: In consideration, the receipt and sufficiency of which is hereby acknowledged, for being allowed to receive services performed by Extensive Detailing LLC (“the Company”), the undersigned participant (the “Participant”) hereby enters into this RELEASE OF LIABILITY AND INDEMNITY AGREEMENT (“Agreement”) as of the date set forth below.

1. ACKNOWLEDGMENT OF RISKS

Participant recognizes and understands that there are risks associated with the services provided by the Company, including but not limited to cosmetic damage, deterioration of pre-existing conditions, or mechanical/electrical failure. The Participant will be held responsible for any resulting damage if known issues were not disclosed. The Participant voluntarily assumes all such risks.

2. APPLICABILITY AND SCOPE OF RELEASES AND INDEMNITIES

For purposes of this Agreement, “Claims” shall mean any past, present, and future claims, losses, costs, expenses, liabilities, demands, or causes of action, including defense costs (e.g., attorney’s fees).
“Released Parties” means Extensive Detailing LLC, its owners, officers, employees, contractors, and affiliates.
The Participant agrees this waiver applies regardless of whether the Claims arise from negligence (ordinary or gross), strict liability, or other causes, and includes personal injury, property damage, weather events, theft, malfunctioning equipment, and known or unknown conditions of the vehicle.

3. RELEASE FROM LIABILITY

Participant hereby RELEASES, WAIVES, AND FOREVER DISCHARGES the Released Parties from any and all Claims arising from or related to the services rendered. This includes, but is not limited to, property damage, personal injury, dissatisfaction with results, or incidental damage to components due to pre-existing issues. The Participant agrees not to pursue legal action against the Released Parties for such Claims.

4. AGREEMENT TO INDEMNIFY AND HOLD HARMLESS

Participant agrees to INDEMNIFY AND HOLD HARMLESS the Released Parties from any and all Claims arising from services rendered, including third-party claims or those arising from minors under their care. This includes reimbursement of any costs incurred in defending against such Claims.

5. ENTIRE AGREEMENT, SUCCESSORS, AND VENUE

This Agreement constitutes the entire, final, and exclusive understanding between the parties and supersedes all prior discussions, representations, or agreements, whether oral or written. No verbal statements or external representations shall modify or contradict its terms. This Agreement shall be binding upon the Participant, as well as their heirs, executors, administrators, successors, and assigns.

This Agreement shall be governed by the laws of the State of Maryland, the District of Columbia, or the Commonwealth of Virginia, as applicable. Jurisdiction and venue for any legal dispute arising out of or related to this Agreement shall lie in the appropriate courts of Montgomery County, Maryland; Washington, D.C.; Virginia; or any other jurisdiction in which the mobile service is performed.

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Section 1: General Assumption of Risk & Client Responsibility

☐ I acknowledge that auto detailing services involve inherent risks, including, but not limited to, cosmetic damage, deterioration of pre-existing conditions, or mechanical/electrical failure. I voluntarily assume all such risks.
☐ I understand that a visual inspection and photo documentation may be performed before and after service to document the vehicle’s condition. These images may be used for internal documentation, insurance purposes, training, or marketing (subject to media consent).
☐ I agree to inform Extensive Detailing of any known damage, defects, or mechanical/electrical issues (e.g., loose trim, oxidized or repainted surfaces, malfunctioning windows/seats) prior to service.
☐ I understand that failure to disclose known issues may increase the risk of damage, for which I will not hold Extensive Detailing liable.

Section 2: Property Left Inside the Vehicle

☐ I understand that Extensive Detailing LLC is not responsible for any lost, stolen, or damaged personal property left inside the vehicle. I accept responsibility for removing any personal items prior to service.

Section 3: Engine Bay Cleaning (If Applicable)

☐ I acknowledge that if engine bay cleaning is performed, there is a risk of moisture intrusion or malfunction due to sensitive electronic components. I release Extensive Detailing from liability for any resulting issues unless due to willful negligence.

Section 4: Paint Correction Services (If Applicable)

☐ I understand that paint correction involves the use of abrasives, machines, and chemicals to remove surface imperfections and that this process carries inherent risks, including but not limited to:
– Burn marks or holograms
– Paint thinning or clear coat failure
– Exposure of previous bodywork or non-factory paint
☐ I acknowledge that the full history and condition of the paint may not be known, and despite all precautions, damage may still occur.
☐ I release Extensive Detailing from any claims, liabilities, or damages arising from or related to the paint correction process and accept full responsibility for the risks involved.

Section 5: Vehicle Operation & Insurance

☐ I authorize Extensive Detailing to move, operate, or test my vehicle as required for the completion of services. I confirm that the vehicle is insured in accordance with applicable state laws and is safe to drive.
☐ I agree to disclose any mechanical issues that could affect safe operation, including but not limited to braking, engine performance, stalling, or tire conditions.

Section 6: Service Limitations & Expectations

☐ I understand that child car seats will not be cleaned or reinstalled under any circumstances.
☐ I understand that vehicle seats will not be removed or reinstalled by unbolting unless designed to be removed via a factory latch system (e.g., third-row quick-release seats).
☐ I agree to clearly identify and communicate any specific areas I do not want serviced prior to the start of work.
☐ I acknowledge that while Extensive Detailing will make reasonable efforts to meet expectations, I will notify the company within 24 hours of service completion if I am dissatisfied so that a resolution may be discussed.

Section 7: Media Release

☐ I authorize Extensive Detailing to use photos or videos of my vehicle for marketing, promotional, or training purposes. I understand that identifying features (e.g., license plates, addresses) will be blurred or removed, and I will not be personally tagged unless I choose to do so.
☐ I do not authorize media use and will inform the company before the appointment.

Section 8: Final Agreement

☐ I certify that I am the legal owner or authorized agent of the vehicle receiving service, and that I am of legal age and capacity to enter into this agreement.
☐ I have read and fully understand this waiver and release and agree to its terms. I have been given the opportunity to ask any questions I may have and have had those questions answered to my satisfaction.

☐ By using this service, I acknowledge that I have read, understood, and voluntarily agree to be bound by all terms outlined in the Release of Liability and Indemnity Agreement.
